Facilities Use Agreement
By and among Mountain Christian Church (hereafter referred to as MCC), Parent Led Academic Network Team, Inc. (hereafter referred to as PLANT, Inc.) and Independent Teachers shall be effective August 27, 2019 - May 26, 2020.
Background
PLANT, Inc. and MCC share a common mission to make disciples for Christ. PLANT, Inc.'s strategy is to encourage Independent Teachers to offer classes for students in K-12 from a Biblical perspective. PLANT, Inc. will provide administrative services to independent teachers and MCC will allow such teachers the use of their facilities for the purpose of teaching and instruction.
Purpose
The purpose of the agreement is to outline the understanding among and set the parameters of the use of MCC facilities by MCC, PLANT, Inc. and Independent Teachers.
Buildings and Time of Use
MCC will make the Youth Building, Library and N-Building (4 classrooms) available on Tuesdays from 9:00am - 3:00pm for the purpose of classroom teaching, mentoring or tutoring. Christine Tidmore and Felisa Palfery, as representatives of MCC, will serve as facilities coordinator and MCC point of contacts to PLANT, Inc. Paul Brouse will act as a backup for either liaison should the need arise.
Scheduling
PLANT, Inc. will schedule classes based on the available buildings and agreed upon time window. PLANT, Inc. will provide MCC facilities coordinator with a completed schedule including name of class, time of class, teacher, assigned room, number and age of students.
Building Access
MCC Facilities Coordinator will provide scheduled Independent Teachers access to designated classroom space 5 minutes prior to scheduled class.
Classes cannot be held at MCC without a facilities coordinator on site. In the event that the facilities coordinator or a substitute is unavailable during scheduled class time, notice will be delivered to PLANT, Inc. and teachers via e-mail of the need to cancel classes. Such notice will preferably be delivered to the teacher 12 hours in advance but no less than 3 hours prior to the start of class. Exception: weather related cancellations will be made the morning classes are held or the night before (based on forecasted conditions). All weather cancellations are based on the APS E. Mtn schools weather delay/cancellations. If the APS E. Mtn schools are delayed or cancelled, PLANT classes will be cancelled.
Classroom Setup and Maintenance
MCC will ensure that rooms are clean before each class begins. Custodial help is scheduled on Mondays and Saturdays each week, except for holidays. MCC will not be responsible to set up rooms to the teacher’s preference. Independent Teachers will be expected to set up the class in the manner they prefer and return the classroom to its original state, including ensuring that all lights are turned off and rooms are cleaned up after each class session. This includes but is not limited to: vacuuming or sweeping and mopping if necessary, putting away all supplies and materials, wiping down any tables and chairs dirtied by the class and taking out any food or spoilable trash generated by the class. If a room is left not properly cleaned, PLANT, Inc. representative, Mona Koerner, will be notified in writing or by e-mail by the Facilities Coordinator.
Internet Access
Teachers will have access to MCC Wi-Fi Internet when available within the facilities during scheduled class times. However, Internet service at MCC is unreliable and spotty and should not be relied upon for the delivery of teaching.
Audio/Visual Equipment
Audio/Visual Equipment is available at MCC, but is not necessarily in working condition. Independent Teachers should provide their own audio/visual equipment as needed for a reliable source of equipment.
Supplies
Teachers will provide all their own supplies including dry erase markers, paper, and copies. MCC will not provide any supplies for teachers use. Teachers will not request MCC staff to make copies for them.
Insurance
PLANT, Inc. will maintain general commercial liability insurance of at least $1,000,000 and will provide a certificate of insurance to MCC annually.
Facility Policies
MCC may at its discretion develop and/or amend policies for the safety of facility users and/or the preservation of the facilities. Such policies will be delivered in writing to PLANT, Inc. to be distributed to Independent Teachers. MCC shall allow one week for distribution of policies or policy changes before such policies are enforced.
Relationship with Teachers
All teachers will be independent contractors and are not to be considered representatives or employees of PLANT, Inc. or MCC. An independent agreement between PLANT, Inc. and each individual teacher will govern the relationship between PLANT, Inc. and the teacher. The PLANT, Inc./teacher agreements will require that each teacher subscribe to PLANT, Inc. Statement of Faith. The agreement will require that teachers abide by the requirements established by MCC for the use of the facilities.
Expectations between Teachers, Parents and Students
Expectations of student conduct and behavior, disciplinary actions, and interactions between the teachers and parents will be governed by a release and consent agreement between the teacher and parent.
Background Checks
Each teacher will be required to provide a criminal background check and child abuse registry check for review by MCC staff. No teacher will be allowed to conduct classes at MCC without having completed an approved background check within the past two years. Teachers who have not had a background check performed by a third party that can be provided to PLANT, Inc. may solicit a background check through PLANT, Inc. The cost of the background check is $17 payable by the Teacher and will it will be delivered to PLANT, Inc. PLANT, Inc. will keep background checks on file. Background checks will be available upon request to MCC staff.
Termination
Apart from breach of contract, MCC or PLANT, Inc. may terminate this agreement at the end of a scheduled semester December 31 for fall or May 30 for spring by giving the other party not less than thirty (30) days written notice. A Teacher may also terminate their participation by giving PLANT, Inc. 30 days written notice. Termination by one teacher shall not nullify the agreement for the remaining parties.
Term
This agreement is for one year from August 27, 2019 to May 26, 2020 and must be renewed annually thereafter.
