Memorandum of Understanding
Between
Parent Led Academic Network Team, Inc.
and
Rio Vista Church of the Nazarene
This Memorandum of Understanding (MOU) sets forth the terms and understanding between Parent Led Academic Network Team, Inc. (PLANT, Inc.) and Rio Vista Church of the Nazarene (RVC) to cooperate in ministering to school-age children for the purpose of making disciples for Christ.
Background
PLANT, Inc. and RVC share a common mission to make disciples for Christ. PLANT, Inc.'s strategy is to encourage independent teachers to offer classes for students in K-12 from a Biblical perspective. PLANT, Inc. wishes to partner with RVC for the delivery of those classes in a physical location that can become a center for independent Christian education.
Purpose
The purpose of the MOU is to outline the understanding between and set the parameters of a partnership between PLANT, Inc. and RVC for the purpose of encouraging independent Christian education.
Scheduling
PLANT, Inc. will provide RVC office staff with a schedule of classes to be held at RVC. PLANT, Inc. will ensure no conflicts occur among PLANT, Inc. sponsored activities. Classes will be placed on the church calendar by the office staff with dates, times and room(s) used to avoid scheduling conflicts with the church or other groups. Classes will only be scheduled between the hours of 9:00am and 4:00pm on Wednesdays and no more than 3 classes will be scheduled at any one time. Any deviation will require written approval by the Ministry Staff of RVC.
Building Access, Classroom Setup and Maintenance..
RVC will provide access to the building between 8:45am and 4:15pm.
RVC will make every effort to have classrooms cleaned at least once per week. Teachers and students will leave everything as they found it and ensure everything is returned to state in which they found it and clean up afterward. Teachers are required to return classroom furniture to its original state and must ensure that all lights are turned off and rooms are cleaned up after each class session. This includes but is not limited to: vacuuming or sweeping and mopping if necessary, putting away all supplies and materials, wiping down any tables and chairs dirtied by the class and taking out any food or spoilable trash generated by the class.
If a room is left not properly cleaned, PLANT, Inc. representative will be notified in writing or by e-mail by a staff member of RVC. After 2 complaints of a room not being cleaned, PLANT, Inc. will be charged for custodial fees. Current custodial fees are $15/hour subject to change. PLANT, Inc. will be notified in writing of any changes in custodial rates.
RVC will ensure that the facilities are kept at comfortable temperature for those classrooms and class times in which PLANT, Inc. has scheduled classes. The temperature shall be kept between 68-75 degrees during scheduled class times. In the event, that RVC is unable to maintain a comfortable room temperature a class may be moved to a different room.
Internet Access
RVC will allow PLANT, Inc. teachers to access the Internet within the facilities during scheduled class times. RVC will ensure that Internet accessibility is working and available in classrooms that are scheduled for classes. RVC makes no guarantee as to the quality or speed of the internet service.
Audio/Visual Equipment
PLANT, Inc. may store a large screen TV at the church for use by the Teachers. RVC will not be liable for anything that may happen to the TV.
Rent
PLANT, Inc. agrees to pay RVC $5 per hour for each hour that classes are held in the building. PLANT, Inc. will submit a log of total hours for each month along with that month’s rent. by the 15th of the following month. Hours are calculated as total hours in the building regardless of the number of rooms in use. A late fee of 5% of the rent per month may be charged if rent is not received by the 15th, or the first weekday after a weekend in which the 15th falls on a Saturday or Sunday. Classes will begin August 2018 and August rent will be paid by September 15, 2018.
Insurance
PLANT, Inc. will maintain general commercial liability insurance of at least $1,000,000 and will provide a certificate of insurance to RVC annually.
Relationship with Teachers
All teachers will be independent contractors and are not to be considered representatives or employees of PLANT, Inc. An independent agreement between PLANT, Inc. and each individual teacher will govern the relationship between PLANT, Inc. and the teacher. The PLANT, Inc./teacher agreements will require that each teacher ascribe to PLANT, Inc. Statement of Faith. The agreement will require that teachers abide by the requirements established by RVC for the use of the facilities including any discipline policy practiced by RVC. RVC will provide PLANT, Inc. a written copy of the currently enforced discipline policy of RVC and will provide updated policies within 30 days of their adoption or implementation by RVC.
Expectations between Teachers, Parents and Students
Expectations of student conduct and behavior, disciplinary actions, and interactions between the teachers and parents will be governed by a release and consent agreement between the teacher and parent.
Disclaimer
PLANT, Inc. will publish a disclaimer on any promotional material in which RVC is mentioned stating that RVC does not endorse the teacher or the teaching content of any of the classes advertised or held at RVC.
Background Checks
Each teacher will be required to provide a criminal background check and child abuse registry check for review by RVC staff. No teacher will be allowed to conduct classes at RVC without having completed an RVC approved background check.
Termination
Either party may terminate this agreement at the end of a scheduled semester December 31 for fall or May 30 for spring by giving the other party not less than thirty (30) days written notice. Rent will be payable only through the date of termination.
Term
This agreement is for one year from the start date of the first scheduled class and must be renewed annually thereafter.
